Hello All,
As per the latest regulations, the employer has to pay for all the labor application cost. My employer has agreed to do my green card, but are little hesitant to pay the cost (due to budget constraint). What legal options/adjustments can I make with my employer so that the cost process is not delayed? Thanks in advance.

Kudos to my colleague Elissa Taub who pointed out something rather interesting that none of the supporters of the Arizona law have told Arizonans. Under federal immigration law, a removal proceeding is a civil proceeding and one is not entitled to a public defender or any assistance in paying for help from an immigration lawyer. However, the new Arizona law makes it a state crime to be illegally present in the state. I applied for extension of stay to California Sercice Center. But if I move to Texas, will be my case transfered to VSC??

if it is an extension of B2 status, I don't think your case will be transferred to a different center if you move to a different state. you just have to inform the service center regarding change of address(I think you can send a AR-11 form) this is just my personal opinion. please check with the lawyer who filed your extension or other experts

Hello,
I am on my OPT (started on 5th Jan 2009) currently and am working for a startup company. However, I am told that the company has funds only to support my position for another 2 months or so.
But the company is ready to sponsor my H1B for April 1st this year to help me keep my immigration status. My question is if my H1B application is approved this year but I loose the job before the H1B kicks in (1st October 2009) can the approved H1B be transferred to a new company, if I get another job?

No more interim EAD at Infopass since Sept 2006.
If it's an emergency like loss of job offer etc. you can take a cover letter with your receipt notice to Infopass and they can fax it to the Service Center for expedited service. Alternatively you can fax it yourself.
The decision whether to expedite your case rests with the Service Center.
Also I would say hang on for a few days if possible. I got my EAD approval e-mail after 101 days since RD from NSC.

I have a work related travel (2 days max) coming up in January. Do I need a canadian visa. I am on AP and my US visa on my passport has expired. My H1 is valid till 2009 (not stamped on the passport).
My question is Do I need a canadian visa? Let me know if anyone had a similar experience.

If you are from a country who is not exempt from a canadian visa (especially for work), you should definitely get one. your AP does not entitle to enter any other country other than the U.S.

I think NSC is still following the EAD processing date unlike TSC which approves EAD application during "receipting".

My husband and I are in a big Dilemma whether to apply for EAD or AP? In the lawyer's note,it says that anyone who is I-140 Beneficiary will not be able to use EAD and AP. Is it true?
We are on our 3 years H1/H4 using I-140 benefits only. What should we do?
Please guide us.
We still have 3 years remaining. Problem - We both have no visa stamping after we got our extentions which why AP is required at this point?
Are there any travel restrictions after we file I-1485 with AP or WITHOUT AP.
Please highlight. Will be very useful for us.

I am planning to joing new empoyer on EAD even though I have proper H1B. Because employer do not want to sponser for anything. My wife is planning to go to india during this period and she will be using H4 for travel. My questions are
1. Can I swith to new job even though my wife is not here and she is going to use H4 visa which she got it as aresult of my h1b visa from my privious employer.
2. What are the thing we need to do or check before joining the new employer.
Any help in this regard is highly appriciated.

My background:
1. Got Ph.D three years ago
2. worked in a hospital as a PI and postdoc training for three years
3. worked as research associate at University of Houston last year
4. working as research assistant professor(Faculty) at UH
5. Four foreign grants including national grant
6. several awards including the First Prize awards in foreign provincial health field
7. Published more than 20 papers, only two are SCI (one is PNAS published this year without citation so far), others are foreign language papers have more than 40 citations.
Now I am preparing files and will apply as EB-1b.
can you tell me the best points to claim?

I am on H1-B visa and applying for my wife's passport(in india),one of the document for making passport is an NOC from husband that has to get from indian embassy which i didn't find on their website(any application for spouse),has anyone come across this situation.Please let me know.

Considering many limitations to move a job from non-profit to for-profit, I am considering moving my job to another non profit. With my current employer, my 6 year H-1 B will expire by the end of next year April. So if my change my employer, I will have a very short time to start the process again till I reach I -140 approval again with the new employer.
I heard that from non-profit to for-profit, you are subject to the quota and you have to apply for H-1B quota. But in this case, your previous 6 year with non profit doesn't count.
But if I move from non-profit to non-profit, do I have to reach I-140 approval before my current H-1 B with my current employer expires? Or do I just get another 3 year with new non-profit employer?
If I have to get I-140 approval with new non-profit employer before my current 6 year H-1 B expires, is it doable?
