Copanies like INFOSYS are not the culprits. This is going tangenatially. It is the local small desi body shops that suck blood and hold candidates life in their hand because of GC. They should be investigated.
Cos big or small are all responsible for the plight of their employees.
Not many from these companies (INFY..etc) crib because a minimal % of employees deputed in US have their GC processed. The ones who care for a GC move on to either a desi body shop or permanent employment.

I didn�t want to go to DC rally due to my surgery appointment (September 6th) because I can not fly for three weeks after the surgery.
Guess what?, I have postponed my surgery appointment date, booked tickets and going to DC rally on Monday evening and flying back on Tuesday night.
I also urge people to take a day off and attend the rally.

A freind of mine came across a gentleman, who is here on work visa and he is facing a unique problem. He is married to two persons and wants to bring his whole family here in the USA. He was looking for answer if he can get both his spouses and kids here on H4 visas. Currently both of them and his kids are in India. Interesting hmmm :D

Its just that we have not yet reached everyone in the community yet. Everyone reading this message, please make sure to pass on the rally information to at least one person you know, this weekend. Then ask that person to pass it on further.
Let us use all our networking to best use here. 10K is not a difficult number. When we started this organization, we could not even get 10 people together, but nobody gave up hope.
The success of the rally, this cause and our own greencard issues depends on each one of us. I'm sure we are all capable of sharing this responsibility.

I feel very sad for the tarnish it has caused .Esp the common Indian working there is bound to be looked upon as a fraud case - and he would have nothing to do with this AT ALL,it spoils the prospects and reputation of genuine people be it anyone Telegu or Non ..as long as he is Indian.
Now all the local regional associations are desperately painting them as scapegoats because if otherwise it will be a big dent to their own rep. And next the Feds will want to go smell fish at any AP run consulting firm . A general fraud impression will be built rapidly around that community.Very unfortunate if that happens. But WHY in the 1st place attempt such a massive fraud ? Bad for all. I just hate it .
BTW all this 1500 student game is happening when the H1B visa laws are the most restrictive so companies find it imposs to file a fresh H1B but its a lot easier to transit a student from F to H.

After getting the EAD/AP within three months, I don't think our problem is solved already. We will be at certain point in time be in the same situation as the poster above.
Who told you that you will get EAD/AP in three months. Nothing will prevent USCIS to develop backlogs in EAD/AP too now. "Oh there were so many filed in June/July so that we can't process them that fast anymore...":cool:

I filed my I485/EAD/AP at Nebraska on July 24th, 2007. Got receipts for all of them on September 19th. Done FP on October 23rd for myself and my wife and saw a LUD on I-485 a day after. EADs were approved and received on October 10th. But i have not received AP yet. Looks like my application is still with NSC. Never got a transfer notice or anything and online status also shows "Case received and pending at Nebraska".
There is only one LUD on AP and that was on September 21st. Nothing after that.
Anybody in the same boat? Do i need to make an infopass to get more information on this. I need to travel in December and want to make sure i get AP before that.

If you got first LUD on AP within last month .. Just wait for some days to complete the month from the day of first LUD. If it is more than 1 month, I believe you should take infopass appointment.

Now, coming to the issue of EAD after I-140 or after I-485...By submitting the I-140 the employer is not only asking the USCIS to approve the need (as certified by the DOL) of a alien as a permanent worker, the employer is also providing the USCIS with particulars of the alien who will be hired. Therefore, by approving the I-140, the USCIS is not only approving the need of the employer, it is also approving the alien for the job. This is also supported by the fact that the USCIS allows concurrent filing of I-140 and I-485 if the priority date is current for that particular country/category. Hence, an EAD after I-140 not only allows the employer to hire an alien already in the company, it also allows the alien who might be working for an employer other than the one which applied for the I-140 to switch jobs, without worrying about being out-of-status, if he is very close to finishing his 6years on an H1B. For an alien who is outside the country when his I-140 is approved (very rare case, but possible), he can enter the US on an H1B sponsored by the petitioning employer and then apply for an EAD for himself and his dependents while waiting for the visa number to be available and file his I-485. NSC probably sent applications to CSC for data entry, I am a july 2 filer, my EAD(I131)/AP(I765) and all receipt notices were sent to me by CSC all are WAC### numbers which means its from CSC, then they sent just the AOS (I485) back to NSC saying they do not have Jurisdiction on the AOS application (Logic behind this is - because my I140 was approved by NSC, I have a LIN### on I140 application).
This transfers happens in the 4 centers all the time no need to worry, there is delay associated though... :(

Guys, we are talking about USCIS - This agency issued visa extension to Mohammad Atta after his death - the guy who rammed AA plane into World Trade Center (9/11). Now can you imagine that? On one hand entire FBI and CIA was behind this tragedy and USCIS had no idea what they were doing. In my personal opinion, do not communicate with them in case you use AC-21. Just wait, if RFE comes RFE comes, if it gets approved it gets approved, if it gets denied, I am outta here! Read this if you have some time.

Agree with you Tony - there are so many members of this forum - I find it hard to believe that everyone's budget is so tight, that they cannot afford to divert $25 per-month to a cause that is going to help them directly.
I am not underestimating the value of $300 per-year, but compared to the value that this is likely to drive, it is certainly an investment that can provide handsome returns.
I would rather NOT believe that most people here are with a free-loader mentality - waiting for others to fund and drive the momentum, while they just keep yapping about their problems and concerns about the situation, laws, regulations, illegals, employers etc. etc.
In my opinion people are missing the big picture of that if everyone contributed, there could be significant momentum that could be created - a $25 per-month contribution could lead to a $500K monthly lobbying fund - which is a non-trivial amount to drive our agenda.

Per some statistics regularly floating around here, IV has 40,000 odd members. A membership fee as small as $1/month!! ($12/year), will INSURE a steady flow of funds, that will make a HUGE difference.
Even if 20,000 of that 40,000 run away due to the $12.00/yr subscription requirement, that still leaves IV with almost a QUARTER million dollars worth of cash at hand, . True, it wil lbe hard work to keep the membership numbers up, but think about it, a smaller, more focused organisation, with enough liquid cash, to be able to hold events, rallys, make campaign contributions etc......

Maybe he can come under asylum or refugee status; after all he also probably has two mother-in-laws there and that should qualify. One is bad enough, but TWO?
